Scott Michael Dunn: Can police arrest me without DNA evidence?
Christopher Combs: Of course. We’ve touched on this before. Everyone these days with the TV shows and things like that think that it requires some type of DNA or some type of physical evidence. But, as I mentioned, allegations are evidence because testimony in court is evidence. And there’s people sitting in prisons all across the country based upon what someone said, what someone testified to. They do not need physical evidence or DNA. Would you agree, Josh?
Joshua Boardman: I would agree. I mean, is DNA sometimes a silver bullet for the state’s attorney? Sure. But oftentimes with these sex cases, there’s not DNA and there never will be DNA because either the type of case or the criminal behavior did not require any sort of DNA evidence. So, yes, many, many, many times convictions to sex crimes occur without any DNA evidence whatsoever.
