725 ILCS 5/116-1 – Motion for New Trial

This law explains how and when a person found guilty can ask for a new trial.

This statute says that after someone is found guilty, they can ask the court to give them a new trial. The request must be in writing, filed within 30 days, and explain the reasons why a new trial should be given.

(a) After a verdict or a guilty finding, the judge can give the defendant another trial if asked.

(b) The defendant must file a written request for a new trial within 30 days after the guilty verdict or finding. The State must get reasonable notice that this request has been made.

(c) The written request has to clearly list the reasons why the defendant wants a new trial.
