720 ILCS 5/16-40(c) – Internet Offenses: Electronic Fencing

This law makes it illegal to sell stolen items online if you know they are stolen.

This Illinois law says that selling stolen goods on the Internet, while knowing they are stolen, is a crime. The punishment depends on how much the stolen items are worth.

(c) Electronic fencing. A person breaks this law when they sell stolen property online while knowing it was stolen. Someone who buys stolen property online without knowing it is stolen is not breaking this law.

(d) Sentence: If the total value of the stolen property is $300 or less, it is a Class 4 felony. If the value is more than $300, it is a Class 2 felony.
