720 ILCS 5/16-40(b) – Internet Offenses: Online Theft by Deception

This law makes it a crime to buy something online using fake, stolen, or unauthorized payment information.

This Illinois law says that if someone uses the internet to buy or try to buy property with a payment they know is fake or stolen, it counts as online theft by deception. The punishment depends on how much money the property is worth.

(b) A person commits online theft by deception when they use the internet to buy or try to buy something from a seller using a payment method they know is made up, stolen, or not approved by the real account owner.

(d) Sentence: The punishment depends on the value of the property involved.

  1. If the property is worth $300 or less, it is a Class 4 felony.
  2. If the property is worth more than $300, it is a Class 2 felony.
