720 ILCS 690/2 – Sale or Delivery of Intoxicating Compounds

This law makes it illegal to sell or give certain chemicals to kids or anyone who plans to inhale them to get high.

This Illinois law bans selling or giving specific chemicals to people who intend to breathe them in to get high. It also sets punishments for those who break the law and gives exceptions for certain legal sales, such as those by stores or doctors.

Sec. 2. Sale or delivery prohibited.

(a) No one can knowingly sell, offer to sell, deliver, or give any compound, liquid, or chemical that can cause intoxication–such as toluene, acetone, or other similar substances–to anyone under 17 years old, unless the young person’s parent or guardian gives written permission. It’s also illegal if the person selling or giving knows or has reason to believe the substance will be used to get high.

(b) No one can knowingly sell, offer to sell, deliver, or give any compound or chemical containing atropine, hyoscyamine, or scopolamine if they know or suspect it will be used to cause intoxication.

Sec. 4. Sentence.

(a) Sentence: Breaking this law is a Class C misdemeanor for a first offense, and a Class A misdemeanor for a second or later offense.

(b) Sentence:

  1. Selling, offering, delivering, or giving substances with atropine, hyoscyamine, or scopolamine to anyone is a Class 4 felony.
  2. This rule does not apply if these substances are used as prescribed or directed by a licensed medical professional.

Sec. 4.5. Exemption.

This law does not apply when a store legally sells or gives products containing atropine, hyoscyamine, or scopolamine as part of normal retail business.
