720 ILCS 646/20 – Methamphetamine Precursor (Unlawful Procurement of Precursors)

This law makes it illegal to have or move chemicals used to make meth if you plan to use them for making drugs.

This Illinois law says that a person cannot have, buy, move, or store ingredients used to make methamphetamine when they intend to use them to create the drug. The punishment depends on how much of the chemical the person has or plans to use.

(a) Meth ingredients or substances in a regular dose.

1. It is illegal to knowingly have, buy, move, keep, or deliver any meth ingredient or product that has one when it is a normal dose of medicine, if the person plans to use it to make meth.
2. The penalties for breaking part (a)(1) are:
   1. Sentence: Less than 15 grams – Class 2 felony.
   2. Sentence: 15 or more grams but less than 30 grams – Class 1 felony.
   3. Sentence: 30 or more grams but less than 150 grams – Class X felony; prison time between 6 and 30 years; fine up to $100,000.
   4. Sentence: 150 or more grams but less than 500 grams – Class X felony; prison time between 8 and 40 years; fine up to $200,000.
   5. Sentence: 500 or more grams – Class X felony; prison time between 10 and 50 years; fine up to $300,000.

(b) Meth ingredients or substances not in a regular dosage or form.

1. It is illegal to knowingly have, buy, move, keep, or deliver any meth ingredient or product in any other form if the person plans to use it to make meth.
2. The penalties for breaking part (b)(1) are:
   1. Sentence: If planning to make less than 10 grams of meth – Class 2 felony.
   2. Sentence: If planning to make 10 or more grams but less than 20 grams – Class 1 felony.
   3. Sentence: If planning to make 20 or more grams but less than 100 grams – Class X felony; prison time between 6 and 30 years; fine up to $100,000.
   4. Sentence: If planning to make 100 or more grams but less than 350 grams – Class X felony; prison time between 8 and 40 years; fine up to $200,000.
   5. Sentence: If planning to make 350 or more grams – Class X felony; prison time between 10 and 50 years; fine up to $300,000.

(c) Evidence rule:

If police find meth ingredients still sealed in the package with the factory label, that is enough proof that what is inside really matches the label and the amount shown on it. Those factory packages can be used as proof in court for this crime.
