720 ILCS 646/15 – Participation In Methamphetamine Manufacturing

This law makes it illegal to make or help make meth, and sets punishments based on how much is made and where or how it’s done.

This Illinois law says that making or helping to make methamphetamine (meth) is against the law. It explains the penalties depending on how much meth is made and if dangerous or special conditions exist, like making it near children or schools.

(a) Participation in methamphetamine manufacturing.

  1. It is illegal to knowingly help make meth when you plan for meth or a mix with meth to be produced.
  2. The punishment depends on how much meth is made:
    1. Sentence: Less than 15 grams – Class 1 felony.
    2. Sentence: 15 to less than 100 grams – Class X felony, prison 6–30 years, and up to $100,000 fine or the drug’s street value.
    3. Sentence: 100 to less than 400 grams – Class X felony, prison 9–40 years, and up to $200,000 fine or the drug’s street value.
    4. Sentence: 400 to less than 900 grams – Class X felony, prison 12–50 years, and up to $300,000 fine or the drug’s street value.
    5. Sentence: 900 grams or more – Class X felony, prison 15–60 years, and up to $400,000 fine or the drug’s value.

(b) Aggravated participation in methamphetamine manufacturing.

  1. It is illegal to make or help make meth in dangerous places or situations that make the crime worse (aggravated), such as:
    1. Doing it in an apartment or other multi-unit building.
    2. Doing it where a child, elderly person, or person with a disability lives or could be harmed.
    3. Doing it where a pregnant woman lives or could be harmed.
    4. Doing it in a place protected by weapons, explosives, guard dogs, or alarms.
    5. Causing someone to die, get badly hurt, or disfigured because of the meth making.
    6. Causing a fire or explosion that damages someone else’s property.
    7. Running, organizing, or paying for the meth operation.
    8. Doing it within 500 feet of a school or place of worship while people are present or activities are happening.
  2. Penalties for aggravated participation:
    1. Sentence: Less than 15 grams – Class X felony, prison 6–30 years, and up to $100,000 fine or the drug’s value.
    2. Sentence: 15 to less than 100 grams – Class X felony, prison 9–40 years, and up to $200,000 fine or the drug’s value.
    3. Sentence: 100 to less than 400 grams – Class X felony, prison 12–50 years, and up to $300,000 fine or the drug’s value.
    4. Sentence: 400 grams or more – Class X felony, prison 15–60 years, and up to $400,000 fine or the drug’s value.
