720 ILCS 570/405 – Calculated Criminal Drug Conspiracy
This law makes it a serious crime to plan or run a drug operation with others to make money or direct the group.
This Illinois law punishes people who plan or help lead a group that sells or handles illegal drugs for profit. It allows the state to take away money or property earned through the crime.
(a) Anyone who takes part in a planned drug conspiracy, as explained below, commits a Class X felony. The fine can be up to $500,000, and the person may lose property as described later in this law.
(b) A person is part of a calculated criminal drug conspiracy when all of the following are true:
- They break certain other drug laws about selling or having drugs.
- They do this as part of a plan with two or more other people.
- They gain something worth more than $500, or they organize, lead, or pay for the plan.
(c) Anyone found guilty of this crime must give up to the State of Illinois:
- Any money or profit they got from the conspiracy.
- Any property, rights, or interests that gave them control or influence over the conspiracy.
(d) The court may issue orders, warnings, or other actions–such as taking bonds or blocking property use–to make sure the forfeited property is handled properly.
