720 ILCS 570/401.1 – Controlled Substance Trafficking
This law makes it illegal to bring drugs into Illinois to sell or make them.
This law says that anyone who brings illegal drugs into Illinois to sell or make them is breaking the law and can face very serious punishment, including long prison time and high fines. It also makes it illegal to use a cell phone to help with drug trafficking.
(a) Anyone who knowingly brings drugs into Illinois to make or sell them, or to help someone else make or sell them, is guilty of controlled substance trafficking. This does not include methamphetamine or fake drugs covered by other rules.
(b) Sentence: A person found guilty of controlled substance trafficking will go to prison for at least twice the normal minimum sentence and can face up to twice the maximum sentence. They can also be fined up to twice the normal fine amount, depending on how much of the drug they brought into Illinois.
(c) Sentence: It is a Class 2 felony, with a fine up to $100,000, to use a cell phone to help with drug trafficking. This penalty is added on top of any other punishment given.
