720 ILCS 5/33E-5 – Improper Disclosure of Information by a Public Official

This law makes it illegal for government workers to open or share sealed bid information in the wrong way.

This law says that government officials or employees can get in trouble if they open sealed bids early, share private bid information, or give out inside details about bids unless it’s their job or allowed by law.

(a) A government official or employee who knowingly opens a sealed bid at a time or place that is not allowed by the bid instructions, or without the right witnesses present, commits a Class 4 felony.

(b) A government official or employee who knowingly shares private details about sealed bids with someone who is interested in the bidding, unless the law allows it or it’s part of their job duties, commits a Class 3 felony.

(c) It is not against the law for a government official or employee to share bid information with someone if that same information is also shared with the general public at the same time.

(d) This law only applies to contracts that are decided using sealed bids.
