720 ILCS 5/26.5-1 – Transmission of Obscene Messages (Harassing Communications)
This law makes it illegal to send dirty or offensive messages over the phone or telegraph to upset someone on purpose.
This Illinois law says that if someone sends messages using rude or obscene language to offend another person through a phone or telegraph, they can be charged with a crime. The judge or jury can decide if the person meant to offend someone based on the language they used.
(a) A person breaks this law when they send messages or use rude, nasty, or immoral words on purpose to upset another person while using a telephone or telegraph system. This includes using equipment or wires belonging to anyone or any business that sends news or messages across states or within Illinois.
(b) The court or jury can guess that a person wanted to offend someone if the words they used were rude, dirty, or immoral.
