720 ILCS 5/25-5 – Unlawful Contact With Street Gang Members
This law makes it illegal to be involved in gang activity if a judge or the law already told you to stay away from gangs.
This law says that if someone has been told by a court or other legal order to stay away from gang members, and they still choose to help or take part in gang-related activities, they are breaking the law. Doing this is considered a Class A misdemeanor, which is a serious offense.
(a) A person breaks this law if they knowingly do something that helps or supports gang activity after being told by the court or other legal authority not to have contact with gang members. This includes if the person was:
- Given probation, conditional discharge, or supervision for a crime, and part of that sentence required them to stay away from gang members.
- Out on bond for a crime, and the bond required them to avoid contact with gang members.
- Told by a judge in any non-criminal case to stay away from gang members.
- Released from prison on parole or supervised release and told that they must not have contact with gang members.
(b) Sentence: Breaking this law is a Class A misdemeanor.
