720 ILCS 5/11-6.5 – Indecent Solicitation of an Adult
This law makes it illegal for someone to set up or arrange for an adult to take part in sexual acts with a child under 17.
This law says that it is a crime to knowingly arrange for someone who is 17 or older to have sexual contact with a person under 17. The punishment depends on the age of the child and the type of sexual act involved.
(a) A person commits the crime of indecent solicitation of an adult if they knowingly do one of the following:
- Arrange for someone 17 or older to have sexual intercourse (as defined by law) with:
- A child under 13; or
- A child between 13 and 16 years old.
- Arrange for someone 17 or older to engage in any other sexual activity (not intercourse) with:
- A child under 13; or
- A child between 13 and 16 years old.
(b) Sentence:
- If the act involves intercourse with a child under 13, it is a Class X felony (the most serious type of felony in Illinois).
- If the act involves intercourse with a child between 13 and 16, it is a Class 1 felony.
- If the act involves sexual contact (not intercourse) with a child under 13, it is a Class 2 felony.
- If the act involves sexual contact (not intercourse) with a child between 13 and 16, it is a Class A misdemeanor.
(c) The word “arranges” includes all kinds of communication – spoken, written, by phone, computer, or any electronic method. The word “computer” is defined the same way as it is in Section 17-0.5 of Illinois law.
