720 ILCS 5/11-14.1 – Solicitation of a Sexual Act
This law makes it a crime to offer someone money or anything valuable in exchange for sexual activity.
This Illinois law says it’s illegal to offer payment or gifts to someone (who isn’t your spouse) for sexual activity. The crime is treated more seriously if the person offered is under 18 or has a severe intellectual disability.
(a) A person breaks this law if they offer someone who is not their husband or wife money, property, or anything valuable in order for that person–or another person who is not their spouse–to perform any kind of sexual activity or sexual touching meant for arousal or pleasure.
(b) Sentence: Normally, this crime is a Class A misdemeanor. But if the person being offered money or value is under 18 years old or has a severe or profound intellectual disability, it becomes a Class 4 felony. Any fines ordered by the court go to a special fund that helps survivors of human trafficking.

(c) This law does not apply if the person involved in prostitution is under 18 years old.
(d) A person cannot be found guilty under this law if the only prostitution involved is their own personal act of prostitution.
