720 ILCS 646/65 – Methamphetamine Conspiracy

This law makes it illegal for people to plan or work together to make or sell methamphetamine.

This law says it’s against the rules for anyone to join a plan to make or sell meth. If someone helps plan it or takes part in it, they can be punished the same as if they did the main crime.

(a) A person breaks the law if they take part in a methamphetamine conspiracy. A person is part of a methamphetamine conspiracy when:

  1. They plan to break one or more parts of this law.
  2. They make an agreement with one or more people to break one or more parts of this law.
  3. They or someone else in the group takes action to help the plan happen.

(b) Sentence: If someone is found guilty of joining a methamphetamine conspiracy, they can get the same punishment as the crime that was being planned. They can also be held responsible for all the meth or ingredients linked to the conspiracy for as long as it lasted.

(c) It is not a defense that the other people in the group weren’t caught, were found not guilty, were charged with something else, couldn’t be tried, or couldn’t legally commit the crime.

(d) If someone is convicted of being part of a methamphetamine conspiracy, the State of Illinois can take away any money or property that came from the plan. The court can also make orders or take actions it thinks are fair to handle or protect the property connected to the case.
