18 U.S.C. § 1594 – General Provisions (Attempt, Conspiracy, and Forfeiture)
This law makes attempts and conspiracies to commit human trafficking and involuntary servitude offenses punishable as completed crimes and mandates forfeiture of property used in or derived from such offenses.
This statute establishes criminal liability for attempts and conspiracies related to federal peonage, slavery, involuntary servitude, forced labor, and trafficking offenses.
It also requires forfeiture of property involved in, used to facilitate, or derived from violations of this chapter, and prioritizes forfeited assets for victim restitution.
What the law prohibits.
A person violates this statute if they:
- Attempt to violate sections 1581, 1583, 1584, 1589, 1590, or 1591
- Conspire with another to violate sections 1581, 1583, 1589, 1590, or 1592
- Conspire with another to violate section 1591
Penalties.
An attempt to violate sections 1581, 1583, 1584, 1589, 1590, or 1591 is punishable in the same manner as a completed violation of the applicable section.
A conspiracy to violate sections 1581, 1583, 1589, 1590, or 1592 is punishable in the same manner as a completed violation of the applicable section.
A conspiracy to violate section 1591 is punishable by a fine under this title or imprisonment for any term of years or for life, or both.
Upon conviction of any violation of this chapter, the court shall order forfeiture to the United States of property involved in, used to facilitate, or derived from the offense, with forfeited assets prioritized to satisfy victim restitution orders.
