18 U.S.C. § 2251A – Selling or buying of children (for sexual exploitation)

This statute criminalizes the sale, purchase, or transfer of custody of a minor for the purpose of sexual exploitation.

Section 2251A focuses on the commercial exchange of children when the intent is sexual exploitation. The statute applies whether the exchange involves money, property, or any other form of value.

What the law prohibits.
A person violates this statute if they knowingly:

  • Sell or buy a minor with the intent that the child be sexually exploited.
  • Transfer custody or control of a minor for purposes related to sexual exploitation.
  • Attempt or conspire to engage in such transactions.

This statute is distinct from trafficking laws and focuses specifically on the exchange itself when tied to sexual exploitation, regardless of whether exploitation ultimately occurs.

Penalties.
Convictions under § 2251A carry severe federal penalties, including long prison sentences that may extend to life imprisonment depending on the circumstances.
