Scott Michael Dunn: What if both people were intoxicated?

Joshua Boardman: In those circumstances, the state’s attorney is going to look at circumstantial evidence and determine what level of impairment. They’re maybe going to look at what was consumed beforehand. The chronology of what occurred and what occurred before that. And if they make a determination that the level of impairment was such where consent could not be given, then that’s certainly going to help with their charging decisions.
