720 ILCS 5/24-3A – Gunrunning
This law makes it illegal to sell or give away three or more guns in a way that breaks gun laws.
This Illinois law says that if someone gives or sells three or more firearms in violation of gun laws, they are committing a serious crime called gunrunning. The punishment depends on how many guns are involved and who the guns are given to.
(a) A person commits gunrunning when they sell or trade three or more guns in a way that breaks state gun transfer rules.
(b) Sentence: A person who commits gunrunning faces different levels of punishment based on how many firearms are transferred.
- It is a Class 1 felony if fewer than 11 guns are transferred.
- It is a Class X felony with a prison sentence between 8 and 40 years if 11 to 20 guns are transferred.
- It is a Class X felony with a prison sentence between 10 and 50 years if more than 20 guns are transferred.
If someone gives guns to a person under 18 years old, they commit a Class X felony no matter how many guns are involved.
