720 ILCS 5/11-23 – Posting of identifying or graphic information on a pornographic Internet site or possessing graphic information with pornographic material
This law makes it a crime to post a person’s personal information or image on a pornographic website without their permission.
This law says that it’s illegal to post someone’s name, contact details, or pictures or videos of minors on adult or pornographic websites without permission. It also explains what kind of acts count as this crime and what the punishments are.
(a) A person 17 or older who shares the name, address, phone number, or email of someone under 17, or of another adult without that person’s consent, on a pornographic website is breaking the law.
(a-5) A person who posts or keeps a picture, video, or digital image of someone under 18 on a pornographic website without that person’s knowledge or consent is guilty of this crime. It still counts even if the person in the picture is fully dressed.
(a-10) A person who posts or keeps a picture, video, or digital image of a child under 18 on a pornographic website, or with pornographic materials, is guilty if the image shows the child in a suggestive pose or focuses on private areas, even through clothing.
(b) Sentence: Breaking part (a) is a Class 4 felony if the victim is 17 or older, or a Class 3 felony if the victim is under 17. Breaking part (a-5) is a Class 4 felony. Breaking part (a-10) is a Class 3 felony.
(c) Definitions:
- “Adult obscenity or child sexual abuse material Internet site” as a website with obscene or child sexual abuse material.
- “Internet” uses the same meaning as in Section 16-0.1.
