18 U.S.C. § 2422 – Coercion and enticement (for illegal sexual activity)

This law makes it a federal crime to persuade, entice, or coerce someone—especially a minor—to engage in illegal sexual activity, even if no physical contact ever occurs.

Section 2422 focuses on communication and intent, not just physical acts. A person can be charged under this statute based on messages, calls, or online interactions alone if prosecutors believe the goal was to persuade or entice someone to engage in illegal sexual activity.

What the law prohibits.
A person violates this statute if they knowingly:

  • Persuade, induce, entice, or coerce an adult to travel across state lines or internationally to engage in prostitution or other illegal sexual activity.
  • Persuade, induce, entice, or coerce a minor (under 18) to engage in prostitution or any criminal sexual activity using the mail, internet, phone, or any form of interstate or foreign communication.
  • Attempt to do any of the above, even if the sexual activity never occurs.

Key point.
For cases involving minors, actual travel, physical contact, or a completed sexual act is not required. Online messages, texts, emails, social media chats, or phone calls alone can be enough if they show intent to persuade or entice.

Penalties.
Punishment depends on the subsection charged:

  • Adults (§ 2422(a)): up to 20 years in federal prison.
  • Minors (§ 2422(b)): a mandatory minimum of 10 years, with possible life imprisonment.
