572.060. Possession of gambling records in the second degree — penalty
Having illegal gambling records is a crime, even if it’s not a large operation
If someone knowingly has records used for illegal betting or lottery games, they can be charged with a misdemeanor—unless those records are just for their own small number of bets.
1. A person commits possession of gambling records in the second degree if they knowingly have gambling records used for:
- (1) Running or helping with illegal betting (bookmaking); or
- (2) Running or helping with illegal lottery or policy games.
2. It’s not a crime under part (1) if the records only show the person’s own bets and there are ten or fewer.
3. The person charged has to raise this exception as part of their defense.
4. Possession of gambling records in the second degree is a class A misdemeanor.
