559.016. Terms of probation — extension.

This law sets how long probation can last and when it can be extended.

Probation usually has a set time limit, but the court can add up to one more year if you break the rules.

1. The basic probation terms are:

  • Felony: 1 to 5 years
  • Misdemeanor: 6 months to 2 years
  • Infraction: 6 months to 1 year

2. The judge must set your probation length when you’re sentenced. The probation division can later change that time.

3. The judge can extend your probation once, but only by one more year—and only if you break the rules and the court agrees. The total probation time can never go over the original limit plus that one extra year.
