579.068. Trafficking drugs, second degree — penalty.
Having or bringing in large amounts of illegal drugs can lead to serious charges.
This law says it’s a crime to have, buy, or bring into Missouri big amounts of certain illegal drugs like heroin, meth, or fentanyl. The more drugs involved, the worse the punishment.
1. A person commits second-degree drug trafficking if they knowingly have, buy, try to buy, or bring into Missouri more than:
- (1) 30 grams of heroin
- (2) 150 grams of cocaine-related substances
- (3) 500 milligrams of LSD
- (4) 30 grams of PCP
- (5) 4 grams of PCP
- (6) 30 kilograms of marijuana
- (7) 30 grams of stimulant drugs like meth or amphetamine
- (8) 30 grams of MDMA (ecstasy)
- (9) 10 milligrams of fentanyl, carfentanil, or similar substances
2. This is normally a class C felony.
3. It becomes a class B felony if the person has or brings in:
- (1) 90 grams or more of heroin
- (2) 450 grams or more of cocaine-related substances
- (3) 1 gram or more of LSD
- (4) 90 grams or more of PCP
- (5) 12 grams or more of PCP
- (6) 100 kilograms or more of marijuana
- (7) Over 500 marijuana plants
- (8) 90 to 449 grams of stimulant drugs like meth or amphetamine
- (9) 90 to 449 grams of MDMA (ecstasy)
- (10) 20 milligrams or more of fentanyl, carfentanil, or similar substances
4. It becomes a class A felony if the person has or brings in 450 grams or more of:
- (1) Stimulant drugs like meth or amphetamine
- (2) MDMA (ecstasy)
5. If someone traffics less than one gram of flunitrazepam, it’s a class C felony the first time and a class B felony for any later offenses.
