§ 579.055 RSMo – Manufacturing Illegal Drugs Is a Felony in Missouri

579.055. Manufacture of a controlled substance — penalties.

Making or trying to make illegal drugs is a felony

1. You commit the offense of manufacture of a controlled substance if you do any of the following without legal permission:

  • Knowingly make, grow, or produce a controlled substance;
  • Try to make, grow, or produce a controlled substance; or
  • Knowingly have a controlled substance with plans to make, grow, or produce it.

2. Penalties get worse depending on where or how it’s done:

  • It’s a class B felony if it happens within 2,000 feet of a school or college;
  • It’s a class A felony if someone dies or is seriously hurt in a fire or explosion caused while trying to make meth;
  • It’s a class C felony if it involves any drug except ≤35g of marijuana or synthetic cannabinoid;
  • It’s a class E felony if it involves making ≤35g of marijuana or synthetic cannabinoid.
