§ 579.045 RSMo – Fake Prescriptions & Prescription Fraud in Missouri

579.045. Fraudulently attempting to obtain a controlled substance — penalty.

Lying or faking to get prescription drugs is a crime

If you try to get a prescription drug by lying, faking a prescription, or pretending to be a doctor, you can be charged with a felony.

1. A person breaks this law if they knowingly try to get or actually get a controlled substance through fraud. This includes:

  • (1) Making a false statement on a prescription, report, or other record.
  • (2) Pretending to be a doctor, pharmacist, or other authorized person to get a drug.
  • (3) Creating or using a fake or forged prescription.
  • (4) Putting a fake or forged label on a container of controlled substances.
  • (5) Having a fake prescription with the intent to get a controlled substance.

2. This offense is a class E felony.

3. Information given to a doctor to illegally get drugs is not considered private. However, a doctor cannot testify about anything learned while treating a patient that was needed for proper medical care.
