571.072. Unlawful possession of an explosive weapon, offense of — penalty

Certain people can’t have explosive weapons—doing so is a felony

If someone has an explosive weapon and has a serious criminal past, is a fugitive, regularly intoxicated, or ruled mentally incompetent, they can be charged with a felony.

1. A person commits the offense of unlawful possession of an explosive weapon if they have an explosive weapon and:

  • (1) They’ve pled guilty to or been convicted of a dangerous felony (as defined in section 556.061), tried to commit one, or committed a similar crime in another state or under federal law—and were in prison for it within the past five years; or
  • (2) They are a fugitive from justice, regularly drunk or on drugs, or have been officially declared mentally incompetent.

2. Unlawful possession of an explosive weapon is a class D felony.
