569.160. Burglary in the first degree — penalty.

Breaking into a place while armed, threatening someone, or with someone inside

First-degree burglary happens when someone breaks into a building to commit a crime and is armed, hurts or threatens someone, or someone else is inside.

1. A person commits first-degree burglary if they break into or stay in a building illegally to commit a crime, and during that time:

  • (1) They are armed with explosives or a deadly weapon; or
  • (2) They hurt or threaten to hurt someone who isn’t part of the crime; or
  • (3) Someone who isn’t part of the crime is inside the building.

2. First-degree burglary is a class B felony.
