568.020. Incest — penalty.

It’s against the law to marry or have sex with close family members

This law makes it a crime to have sexual intercourse or claim to be married to certain close relatives, even if the relationship is through adoption.

1. A person commits incest if they marry, pretend to marry, or have sex (including oral or anal sex) with someone they know is any of the following:

  • (1) A direct relative, like a parent, child, grandparent, or grandchild;
  • (2) A stepchild, if the marriage that made them a stepchild is still in place;
  • (3) A brother or sister, even if they’re only half-siblings;
  • (4) An uncle, aunt, niece, or nephew (only if fully related by blood).

2. Incest is a class E felony.

3. If someone has already been convicted of incest before, they cannot get probation for another incest charge.
