566.100. Sexual abuse in the first degree, penalties.
Touching someone sexually without their clear consent is a serious crime.
This law makes it illegal to touch someone in a sexual way if they can’t give consent or if force is used.
1. A person commits first-degree sexual abuse by having sexual contact (touching someone’s private parts for sexual purposes, either directly or through clothing) with someone who is unable to consent—because they’re unconscious, confused, mentally impaired, or forced.
2. This is a class C felony, but becomes a class B felony if the victim is under 14 or if the act is considered an aggravated sexual offense.
