720 ILCS 5/16-31 – Transmission of Personal Identifying Information
This law makes it illegal to secretly take or share someone’s personal information from a financial transaction without their permission.
This statute says that it’s against the law to record or share another person’s private information from a financial transaction, like when they use a credit or debit card, unless you are part of the transaction or have permission. There are some exceptions for law enforcement and normal business use.
(a) A person breaks this law if they are not part of a financial transaction and knowingly do one of the following without permission from the person involved:
- Secretly take photos, recordings, or electronic copies of someone’s personal information during the transaction.
- Share, send, or spread that personal information to others.
(b) This law does not:
- Stop businesses from legally using personal information in the normal course of business.
- Apply to police officers or their agents doing their lawful duties.
- Prevent a person from being charged with other crimes while committing or trying to commit this one.
(c) Sentence: Anyone who breaks this law commits a Class A misdemeanor.
