720 ILCS 635/2 – Sale of Hypodermic Syringes and Needles
This law explains who can sell or get hypodermic needles and syringes in Illinois.
This law makes sure that syringes and needles are sold or given only to certain people or under strict conditions. It also allows adults to buy limited amounts from a pharmacy for safe use.
(a) In general, hypodermic syringes or needles can only be sold, given, or traded to certain professionals like pharmacists, doctors, dentists, veterinarians, embalmers, or hospital staff with proper written approval. However, people who own or care for animals or those doing scientific work or working or volunteering in a needle access program can have and use them legally.
(b) A pharmacist can sell up to 100 new, clean syringes or needles to anyone who is at least 18 years old. These items must be kept in the pharmacy where only authorized staff can reach them, and they can only be sold from the pharmacy department.
(c) If a pharmacy has sterile syringes or needles, a pharmacist should use their judgment to sell them to anyone who qualifies and needs them for using medicine. The pharmacist can also offer advice or connect the person to health services if needed.
