720 ILCS 600/3 – Sale of Drug Paraphernalia
This law makes it a crime to sell or give away drug items, especially to kids or pregnant women, and says that stores selling them can be shut down.
This Illinois law says it’s illegal to sell, keep for sale, or give away items used for taking illegal drugs. It also explains the punishments for breaking this rule and allows the government to close stores that keep selling these items.
(a) It is illegal for anyone to sell, offer for sale, or deliver any item made for using illegal drugs. Doing this is a Class 4 felony and comes with a fine of at least $1,000 for each item sold. If someone 18 years or older sells or gives a drug item to someone under 18, it becomes a Class 3 felony.
(b) Selling or giving a drug item to a woman who you know is pregnant is a Class 2 felony.
(c) Any store, building, or place that sells or keeps drug items to sell is called a public nuisance. This means the place breaks the law and can be shut down by the State’s Attorney (the local prosecutor).
The court can act quickly to stop the sale by ordering a temporary or preliminary stop without requiring a bond. If the court later finds that the place was being used for illegal sales with the owner’s permission, the court can stop anyone from using that location for one year.
However, the owner can reopen the place sooner by paying the court a bond between $5,000 and $10,000. This bond promises that no crimes involving drug items will happen there again, and that the owner and bond guarantor will cover any fines or costs that occur if the law is broken again.
