720 ILCS 5/8-2 – Conspiracy

This law says that if people plan together to break the law, they can be charged with conspiracy.

This Illinois law explains what it means to commit conspiracy, what defenses are not allowed, and what punishments apply. It means that agreeing with others to commit a crime, even before it happens, can be a crime by itself if any step is taken to make it real.

(a) Elements of the offense. A person commits conspiracy when they agree with someone else to commit a crime and plan to make it happen. The law requires that one of them actually does something to move the plan forward before anyone can be found guilty.

(b) Co-conspirators. It is not an excuse that the other people in the plan were never caught, charged, or convicted, received different punishments, were found not guilty, or couldn’t actually commit the crime. If you joined the plan, you can still be guilty of conspiracy.

(c) Sentence. The punishment for conspiracy depends on how serious the planned crime is:

  1. If the plan was for a very serious crime (like a Class X felony), the punishment is one level lower (a Class 1 felony). Each lower crime level is punished one step down. Misdemeanors can lead to fines, jail time, or both, up to the maximum allowed for that crime.
  2. Some conspiracies, like planning aggravated insurance fraud or insurance fraud against the government while being the organizer, are punished as Class X felonies (the most serious kind).
  3. Plotting to commit first degree murder or certain kinds of major insurance fraud leads to a Class 1 felony sentence.
  4. Planning regular insurance fraud or government insurance fraud leads to a Class 2 felony sentence.
  5. Planning crimes like prostitution, pimping, gambling, or illegal weapons possession leads to a Class 3 felony sentence.
