720 ILCS 5/31-6(c) – Escape From a Peace Officer

This law says it’s a crime to run away from police custody after being arrested.

If someone who is under arrest tries to escape from a police officer, they can be charged with a felony or misdemeanor depending on what crime they were arrested for.

(c) If a person is lawfully under arrest by a police officer for doing something that is a felony, or would be a felony if an adult did it, and that person purposely escapes from custody, they commit a Class 2 felony.
But if the person was arrested for something that is only a misdemeanor, or would be a misdemeanor if an adult did it, and they purposely escape from custody, they commit a Class A misdemeanor.
