720 ILCS 5/31-6(b) – Escape From a Penal Institution (Misdemeanor)
This law makes it a crime for someone charged with or convicted of a misdemeanor to escape or not return to jail when they are supposed to.
This statute explains that if a person charged with or convicted of a misdemeanor runs away or doesn’t follow jail or home confinement rules, they can face more misdemeanor charges, depending on what they did.
(b) A person convicted of a misdemeanor or charged with one, or a minor found delinquent for something that would be a misdemeanor if done by an adult, who purposely escapes from a jail or from an employee guarding them, commits a Class A misdemeanor.
If that person purposely does not show up at jail when required, does not return from a break or work release, or does not follow the rules of home confinement, they are guilty of a Class B misdemeanor.
