720 ILCS 5/31-1a – Disarming a Peace Officer or Correctional Institution Employee

This law makes it a serious crime to take or try to take a police officer’s or correctional worker’s weapon without their permission.

This statute says that if someone takes or tries to take a weapon from a police officer or correctional employee while they are doing their job, they can face major felony charges.

(a) If a person, without permission, takes a weapon from someone they know is a police officer or correctional employee while that officer or employee is working or from right next to them, that person commits a Class 1 felony.

(b) If a person, without permission, tries to take a weapon from someone they know is a police officer or correctional employee while that officer or employee is working or from right next to them, that person commits a Class 2 felony.
