720 ILCS 5/29D-15.2 – Possession of a Deadly Substance

This law makes it illegal to have or move deadly materials if you plan to use them for a serious crime or know someone else will.

This Illinois law says you can’t make, carry, or have dangerous things like poison gas, harmful chemicals, or radioactive materials if you want to use them to commit a serious crime, or if you know someone else wants to use them that way.

(a) A person breaks this law when they have, make, or move any deadly poison gas, harmful biological or chemical material, or radioactive substance with either of these intentions:

  • They want to use it to commit a serious crime.
  • They know someone else plans to use it to commit a serious crime.

(b) Sentence: Breaking this law is a Class 1 felony. If found guilty, the person can be sent to prison for at least 4 years but no more than 30 years.
