720 ILCS 5/24-1.5 – Reckless Discharge of a Firearm

This law says it’s a crime to shoot a gun carelessly in a way that could hurt someone.

In Illinois, it’s against the law to fire a gun in a reckless or dangerous way that puts people at risk. If this happens from a moving car and the driver knows about it, the driver can also be held responsible. This crime is punished as a Class 4 felony, but it does not apply to police officers doing their job.

(a) A person breaks this law if they shoot a gun carelessly in a way that could hurt another person.

(b) If someone shoots a gun recklessly from a moving car and the driver knows and allows it, the driver is also responsible for the shooting.

(c) Sentence: This crime is a Class 4 felony, which is a serious charge that can lead to jail time.

(d) This law does not apply to police officers when they are doing their official duties.
