720 ILCS 5/17-57 – Defrauding Drug And Alcohol Screening Tests
This law makes it illegal to cheat or help someone cheat on a drug or alcohol test.
This Illinois law says people cannot sell, give away, or use fake or changed samples to trick drug or alcohol tests. It also sets a fine and felony charge for breaking this law.
(a) A person may not:
- Make, sell, give away, share, or advertise fake or real substances, or bring urine into Illinois, if the goal is to trick a drug or alcohol test.
- Swap or change a sample, or advertise tools or tricks for doing this, to try to fool a drug or alcohol test.
- Mix substances with something else on purpose to cheat a drug or alcohol test.
- Make, sell, or have chemicals meant to be used for mixing with other substances to cheat a drug or alcohol test.
(b) If a person sells or gives something that comes with a heating element, other cheating device, or written instructions for how to fool a test, that can be used as proof they meant to break this law.
(c) Sentence: Anyone who breaks this law commits a Class 4 felony and must pay at least a $1,000 fine.
(d) A “drug or alcohol screening test” can include tests like urine, hair, sweat, spit (saliva), blood, fingernail, or eye drug tests.
