720 ILCS 5/12C-65 – Unlawful Transfer of a Telecommunications Device to a Minor
This law makes it illegal to give a phone or similar device to a minor if you intend for them to use it to commit a crime.
This Illinois law says that it’s against the law to give or sell a telecommunications device, like a cellphone or radio transmitter, to someone under 18 if you mean for them to use it to break certain laws. Doing so is a Class A misdemeanor and could lead to losing property used in the crime.
(a) A person breaks this law when they give, sell, or hand over a phone or any communication device to someone younger than 18, planning for that device to be used to commit a crime under Illinois law, the Cannabis Control Act, the Controlled Substances Act, or the Methamphetamine Control and Community Protection Act.
(b) The term “telecommunications device” means something that can send or receive voices, messages, or signals, whether it’s a portable phone, a car radio, or something similar. This includes cell phones, pagers, transmitters, and receivers, but does not include regular AM or FM radios meant only for listening.
(c) Sentence: Breaking this law is punished as a Class A misdemeanor.
(d) If someone commits this crime, the devices or property involved can be taken and forfeited under Illinois law, as stated in the Code of Criminal Procedure of 1963.
