720 ILCS 646/60 – Methamphetamine Possession

This law makes it illegal to have methamphetamine or anything that contains it.

If someone is caught with meth, how serious the crime is depends on how much they have. The more they have, the more serious the punishment can be.

(a) It is against the law to knowingly have methamphetamine or anything that has meth in it.

(b) If a person breaks this law, the punishment depends on how much meth they had:

  1. Sentence: Having less than 5 grams is a Class 3 felony.
  2. Sentence: Having 5 to less than 15 grams is a Class 2 felony.
  3. Sentence: Having 15 to less than 100 grams is a Class 1 felony.
  4. Sentence: Having 100 to less than 400 grams is a Class X felony. Prison time can be from 6 to 30 years, and the fine can be up to $100,000.
  5. Sentence: Having 400 to less than 900 grams is a Class X felony. Prison time can be from 8 to 40 years, and the fine can be up to $200,000.
  6. Sentence: Having 900 grams or more is a Class X felony. Prison time can be from 10 to 50 years, and the fine can be up to $300,000.
