720 ILCS 550/5.2 – Delivery of Cannabis on School Grounds
This law makes it illegal to deliver cannabis on or near school property, with severe penalties depending on the situation.
This Illinois law says that anyone who gives or sells cannabis within 500 feet of school property, on school grounds, or in a school vehicle when kids are present or likely to be there can face serious criminal charges and large fines. The closer the offense to school activity, the harsher the punishment.
(a) If someone delivers a 500 to 2,000 grams of cannabis in or near a school or school vehicle, or within 500 feet of school property, and kids under 18 are present or expected, or it happens during school hours, the person commits a Sentence: Class 1 felony and can be fined up to $200,000.
(b) If someone delivers 30 to 500 grams of cannabis in or near a school or school vehicle, or within 500 feet of school property, and kids under 18 are present or expected, or it happens during school hours, the person commits a Sentence: Class 2 felony and can be fined up to $100,000.
(c) If someone delivers 10 to 30 grams of cannabis in or near a school or school vehicle, or within 500 feet of school property, and kids under 18 are present or expected, or it happens during school hours, the person commits a Sentence: Class 3 felony and can be fined up to $50,000.
(d) If someone delivers 2.5 to 10 grams of cannabis in or near a school or school vehicle, or within 500 feet of school property, and kids under 18 are present or expected, or it happens during school hours, the person commits a Sentence: Class 4 felony and can be fined up to $25,000.
(e) If someone delivers up to 2.5 grams of cannabis in or near a school or school vehicle, or within 500 feet of school property, and kids under 18 are present or expected, or it happens during school hours, the person commits a Sentence: Class A misdemeanor.
(f) This law does not apply to old or closed school buildings that are no longer being used as active schools, even if they still look like one.
