720 ILCS 5/12-5.3 – Use of a Dangerous Place for the Commission of a Controlled Substance or Cannabis Offense
This law makes it a serious crime to use or control a dangerous place for making, selling, or storing illegal drugs or cannabis.
This law says it’s a Class 1 felony to use a place that is unsafe–like one with explosive chemicals or weapons–to make or sell illegal drugs or cannabis. It also explains what counts as proof that a place was meant for drug manufacturing and what “place” means under this law.
(a) A person breaks this law if they knowingly control a place intending to make, produce, deliver, or store drugs or cannabis illegally, and either:
- The place is dangerous because it contains substances or materials that could cause fire, explosion, or harm to people through toxic chemicals or gases, or
- The place or surrounding area has weapons, explosives, or harmful devices set up in a way that could seriously injure someone.
(b) It can be assumed that a place was meant for making illegal drugs if ingredients used to make drugs are found near equipment or chemicals that help with drug production.
(c) The word “place” includes any building, vehicle, or location that provides privacy or tools for making, keeping, or selling illegal drugs or cannabis.
(d) Anyone found guilty of this crime commits a Class 1 felony.
