625 ILCS 5/11-502 – Illegal Transportation or Possession of Alcoholic Liquor in a Motor Vehicle
This law says that people can’t have open alcohol in the part of a car where people sit.
This Illinois law makes it illegal for drivers or passengers to have open alcohol in a car on the road, unless it’s sealed and in its original container. There are special rules for limousines, charter buses, and motor homes, but the driver still cannot drink.
(a) Drivers are not allowed to carry or have alcohol in the passenger part of a car on a public road, unless the alcohol is in its original, sealed container. This rule doesn’t apply in the specific situations listed in section (c).
(b) Passengers are also not allowed to carry or have alcohol in the passenger part of a car on a public road, unless the alcohol is in its original, sealed container. This rule doesn’t apply in the specific situations listed in section (c).
(c) This rule does not apply to passengers riding in a limousine, a charter bus, or a motor home when those vehicles are used for their usual purposes. However, the driver of any of these vehicles is never allowed to drink alcohol or have it near the driver’s seat. If alcohol is found near the driver, that’s enough proof that the law was broken. A limousine means a car that’s divided by a partition and used to transport paying passengers, driven by someone with the right license.

(e) Sentence: If a driver breaks this rule more than once within one year, their driver’s license can be suspended.
(f) Sentence: If a driver under 21 years old is caught with open alcohol in the car, they can lose their driver’s license.
