18 U.S.C. § 1035 – False statements relating to health care matters
This law makes it a crime to knowingly make false statements or use false documents in connection with health care services, claims, or payments.
Section 1035 applies to anyone who lies or uses misleading information in matters involving health care benefits or payments. The law covers statements made to federal programs like Medicare and Medicaid, as well as any federally funded health care benefit program.
What the law prohibits.
A person violates this statute if they knowingly do any of the following:
- Make false statements in any health care document, record, or claim.
- Use fake or misleading information when seeking payment for health care items or services.
- Cover up or hide facts that are important to a health care claim or investigation.
- Submit or help submit false reports or certifications related to medical treatment or billing.
Penalties.
Violations of § 1035 are federal felonies and can result in:
- up to 5 years in federal prison,
- fines, and
- repayment of money obtained through the false statements.
The law does not require that anyone actually receive money or that a fraud scheme succeed — the false statement itself is enough for a charge.
