720 ILCS 5/21-7 – Criminal Trespass To Restricted Areas And Airport Properties
This law makes it illegal to go into or stay in parts of an airport that are off-limits or restricted unless you have permission.
This law says people cannot enter or stay in restricted parts of an airport without permission. It also makes the crime more serious if someone enters those areas with fake identification or a weapon.
(a) A person breaks this law if they enter or stay in any restricted part of an airport when:
- They’ve been told by the airport authority that they are not allowed to go there.
- They use fake documents or lie about who they are to gain access.
- They wear a uniform or ID badge to pretend to be an airport worker, airline employee, or contractor in order to enter.
(b) A person commits an aggravated crime if they enter or stay in a restricted area of an airport after being told not to and have a weapon, fake weapon, or ammunition with them.
(c) Being told an area is restricted means someone was personally warned (by word or writing), or that there are clear signs at every entry saying people cannot go in.
(d) Blank.
(e) Blank.
(f) “Restricted area” and “restricted landing area” mean the same as in the Illinois Aeronautics Act, plus any other area the airport authority marks as restricted. “Airman” and “airport” also have the same meanings as in that law.
(g) The rule about using fake identities does not apply to police officers or other government officials doing their jobs.
(h) Sentence:
- Breaking subsection (a)(2) (using fake documents or lying) is a Class A misdemeanor.
- Breaking subsection (a)(1) or (a)(3) (entering after being told not to or impersonating someone) is a Class 4 felony.
- Breaking subsection (b) (aggravated tresspass in this law) is a Class 3 felony.
