18 U.S.C. § 666 – Theft or bribery concerning programs receiving federal funds

This statute makes it a federal crime for an employee or agent of an organization that receives federal funds to steal property or to offer or accept bribes involving the organization’s business.

Section 666 applies to state and local governments, tribal governments, nonprofits, schools, housing authorities, and any organization that receives at least $10,000 in federal assistance during a one-year period. The statute covers two major categories of crimes: stealing or misusing the organization’s money or property, and offering or accepting bribes connected to its business or decisions.

What the law prohibits.
A person violates this statute if they are an agent of a covered organization (such as an employee, manager, officer, or representative) and they knowingly:

  • Embezzle, steal, or intentionally misuse money, property, or assets worth $5,000 or more that belong to, or are under the control of, the organization.
  • Solicit or accept bribes—anything of value—intending to be influenced or rewarded in connection with the organization’s business, contracts, or transactions of $5,000 or more.
  • Give, offer, or promise anything of value to influence an employee or agent of the organization in decisions involving $5,000 or more.

Importantly, the federal government does not have to show that the stolen money was federal money—only that the organization received federal funds.

Federal funding requirement.
To bring charges under § 666, prosecutors must show that the organization received $10,000 or more in federal benefits during a continuous 12-month period.

Compensation exception.
The law does not apply to legitimate salary, wages, fees, or reimbursements paid in the ordinary course of business.

Penalties.
A conviction under § 666 can result in:

  • up to 10 years in federal prison, and
  • substantial fines.

Attempts and conspiracies can be punished the same as completed acts.
