579.074. Unlawful possession of drug paraphernalia — penalty.
Using or having drug tools to make or take drugs is a crime.
This law makes it illegal to use or have tools or equipment for making, using, or hiding illegal drugs. Penalties depend on what the tools are used for and any past drug charges.
1. A person commits unlawful possession of drug paraphernalia if they knowingly use, or plan to use, drug paraphernalia (like tools or containers) to grow, make, store, or use illegal drugs or fake drugs.
2. This is a class D misdemeanor, unless the person has a past drug-related conviction. If they do, it becomes a class A misdemeanor. Prior convictions must be properly proven in court.
3. It is a class E felony if the tools are used or intended to be used together to make or process meth or amphetamine or similar drugs.
