579.065. Trafficking drugs, first degree — penalty.
Selling or making large amounts of certain drugs is a serious crime in Missouri.
This law makes it illegal to knowingly make, sell, or try to sell big amounts of dangerous drugs like heroin, cocaine, meth, or fentanyl. Bigger amounts mean harsher penalties.
1. A person commits first-degree drug trafficking if they knowingly make, sell, or try to make or sell more than:
- (1) 30 grams of heroin
- (2) 150 grams of cocaine-related substances
- (3) 500 milligrams of LSD
- (4) 30 grams of PCP (phencyclidine)
- (5) 4 grams of PCP
- (6) 30 kilograms of marijuana
- (7) 30 grams of stimulants like meth or amphetamine
- (8) 30 grams of MDMA (ecstasy)
- (9) 1 gram of flunitrazepam (first offense)
- (10) Any amount of GHB (gamma-hydroxybutyric acid) for the first offense
- (11) 10 milligrams or more of fentanyl or carfentanil or similar substances
2. This offense is normally a class B felony.
3. It becomes a class A felony if the amounts are even larger or happen in certain places:
- (1) 90 grams or more of heroin
- (2) 450 grams or more of cocaine-related substances
- (3) 1 gram or more of LSD
- (4) 90 grams or more of PCP
- (5) 12 grams or more of PCP
- (6) 100 kilograms or more of marijuana
- (7) 90 grams or more of stimulant drugs like meth or amphetamine
- (8) More than 30 grams of stimulants if near a school, housing project, or hotel
- (9) 90 grams or more of MDMA
- (10) More than 30 grams of MDMA if near a school, housing project, or hotel
- (11) 1 gram or more of flunitrazepam for a second or later offense
- (12) Any amount of GHB for a second or later offense
- (13) 20 milligrams or more of fentanyl or carfentanil or similar substances
